1. Introduction
Welcome to LTCART ("LTCART," "the Platform," "we," "our," "us"), a payment-hold platform designed to make peer-to-peer transactions safer. LTCART temporarily holds buyer funds until the buyer confirms receipt of the item in the condition described. LTCART is a product of Lantigua Technologies Inc., a Delaware corporation. This platform is operated by Lantigua Technologies Inc.
LTCART is not a bank, payment hold agent, fiduciary, or legal arbitrator. We provide a payment-hold mechanism only. Funds are held exclusively by third-party payment processors.
By using LTCART, you agree to these Terms of Service ("Terms").
2. Eligibility
To use LTCART, users must:
- Be at least 18 years old
- Reside in the United States (Dominican Republic support coming soon)
- Pass identity verification if required by the payment processor
- Not be prohibited from online commerce
3. Description of Services
LTCART provides a payment-hold system where:
- Buyer sends payment using an approved payment processor
- Funds enter a temporary payment hold
- Seller ships or delivers the item
- Buyer inspects the item
- Funds are released to the seller
LTCART does not guarantee item quality, authenticity, or performance.
4. Payment Processing
Payments are processed through approved payment service providers (PSPs). LTCART does not directly handle user funds. PSPs may impose fraud checks, verification, and limitations. LTCART is not responsible for PSP actions.
5. Link Previews and Third-Party Content
LTCART may display link previews when users share URLs from external platforms (such as Facebook Marketplace, Instagram, Twitter/X, YouTube, and others). These previews include publicly available metadata such as titles, descriptions, and images provided by the third-party website.
Important disclaimers:
- All previewed content, including images and metadata, remains the property of the original content owner and hosting platform.
- LTCART retrieves only publicly accessible Open Graph metadata tags and images for display purposes to improve user experience.
- LTCART does not claim ownership of any third-party content displayed in link previews.
- Link previews are cached temporarily (up to 24 hours) to improve performance and reduce server load on external platforms.
- LTCART is not responsible for the accuracy, legality, or appropriateness of content from external sources.
If you are a content owner and wish to have your content removed from link previews, please contact us at support@ltcart.store.
6. Buyer Responsibilities
Buyers must:
- Review item descriptions carefully
- Inspect items within the inspection window
- Report issues before the window closes
- Act in good faith
The inspection window is critical. Once funds are released, LTCART cannot forcibly retrieve funds.
If fraud is discovered after release, the buyer may open a dispute. LTCART will notify the seller, review evidence, and attempt voluntary recovery. If PSP rules allow, future payouts to the seller may be held or offset. Recovery is not guaranteed.
7. Seller Responsibilities
Sellers must provide truthful, complete item descriptions, disclose defects, ship promptly, and act in good faith. Misrepresentation may result in account suspension or PSP actions.
8. Confirmation & Release of Funds
Funds are released when the buyer confirms delivery and condition, or when the inspection window expires without response.
9. Cancellations
Transactions may be canceled:
- Before shipment
- By mutual agreement
- When PSP or risk protocols trigger cancellation
10. Dispute Resolution (LTCART-Assisted)
LTCART assists in disputes involving fraud or misrepresentation. We may collect:
- Listing data
- Photos/videos
- Delivery info
- Communications
- Metadata
After evidence review, LTCART may:
- Release funds to seller
- Refund buyer
- Issue partial refund
LTCART is not a legal arbitrator but issues platform-based determinations.
11. Chargebacks & Bank Disputes
- Users agree to resolve all issues through LTCART's dispute process before funds are released.
- Once funds are released to the seller, payments are final within the LTCART platform.
- If a buyer initiates a bank chargeback:
- The payment processor sends a chargeback notice to LTCART.
- LTCART submits all available evidence.
- The issuing bank decides the final outcome.
- LTCART is not responsible for bank‑issued chargeback outcomes.
- If a chargeback is lost:
- The payment processor may debit LTCART.
- LTCART may take action against accounts involved, including restricting protection, payout eligibility, or suspending accounts.
- Chargeback abuse is grounds for account suspension or removal.
This clause ensures full alignment with card network rules, and global banking requirements.
12. Post-Dispute Legal Support
After dispute deadlines, users may pursue civil action. LTCART may provide existing:
- Photos/videos
- Item descriptions
- Message logs
- Metadata timestamps
- Delivery records
LTCART does not create new evidence or provide legal advice.
13. Prohibited Items
The following items are banned from LTCART:
- Illegal goods
- Weapons
- Drugs
- Stolen items
- Counterfeit items
- Crypto sales
- PSP-prohibited items
14. Fees and Charges
Fees may apply to buyers or sellers, including:
- LTCART platform fee (NON-REFUNDABLE)
- PSP processing fees (NON-REFUNDABLE)
- Conversion fees
- Chargeback/dispute fees (NON-REFUNDABLE if charged by PSP)
Fees appear at checkout.
14.1 Refund Limitations
- Payment processor (PSP) fees are NOT refundable
- LTCART platform fees are NOT refundable
- Chargeback and dispute fees charged by PSPs are NOT refundable
If the payment processor automatically returns disputed funds to the buyer as part of its chargeback process, the refund amount will be debited from the platform or the seller's connected account in accordance with the processor's policies.
Refunds apply only to the net recoverable amount after deductions. LTCART may provide screenshots or PSP policy references upon request.
15. Account Suspension
LTCART may suspend or terminate accounts for:
- Fraud
- Misrepresentation
- Chargeback abuse
- Illegal activity
- Terms violations
- PSP flags
16. Limitation of Liability
LTCART is not responsible for:
- Item condition
- Misconduct by users
- Shipping losses
- PSP delays
- Losses after payout release
LTCART's maximum liability is limited to the LTCART fees paid in the 90 days prior to a claim.
17. Not an Escrow Service
LTCART is not a traditional escrow service or fiduciary. All funds are handled by third-party payment service providers (PSPs).
18. Patent Pending
LTCART's systems, workflows, and technology are protected under U.S. Patent Pending status (USPTO Application No. 63/850,573). Unauthorized reproduction or use of LTCART's proprietary systems is prohibited.
19. Governing Law
These Terms are governed by the laws of the State of Delaware, without regard to conflict of law principles. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Delaware, except as provided in Section 22.
20. Modifications
LTCART may update these Terms at any time. Updates are effective upon posting to ltcart.store. Continued use of the platform after updates constitutes acceptance of the revised Terms.

22. Dispute Resolution & Arbitration
23.1 Informal Resolution First
Before initiating arbitration, users must contact LTCART at support@ltcart.store and attempt to resolve the dispute informally. LTCART will have 30 days to respond and attempt resolution.
23.2 Binding Arbitration
If informal resolution fails, all disputes, claims, or controversies arising out of or relating to these Terms, the LTCART platform, or any transaction conducted through LTCART shall be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. The arbitration shall be conducted virtually. The arbitrator's decision is final and binding on both parties.
23.3 Class Action Waiver
YOU AND LTCART AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING. THE ARBITRATOR MAY NOT CONSOLIDATE MORE THAN ONE PERSON'S CLAIMS AND MAY NOT PRESIDE OVER ANY FORM OF CLASS PROCEEDING.
23.4 Small Claims Exception
Notwithstanding the above, either party may bring an individual claim in small claims court if the claim qualifies under that court's jurisdictional limits. LTCART expressly reserves the right to pursue fraudulent chargeback recovery and term violation claims in small claims court. All users are identity-verified and subject to civil action in the applicable jurisdiction.
23.5 Arbitration Costs
AAA filing fees are governed by AAA's Consumer Arbitration Rules. LTCART will cover AAA administrative fees for claims under $500. Each party is responsible for their own legal fees unless the arbitrator determines otherwise.
23.6 Opt-Out
Users may opt out of this arbitration agreement within 30 days of first accepting these Terms by emailing support@ltcart.store with the subject line "Arbitration Opt-Out." Opting out does not affect any other terms.
23.7 Severability
If any part of this arbitration agreement is found unenforceable, the remaining parts remain in full effect. If the class action waiver is found unenforceable, the entire arbitration agreement is void.
23. Optional Transaction Protection Products
LTCART may in the future offer optional transaction protection products, guarantee programs, or insurance-backed coverage as additional platform services ("Protection Products"). Any such Protection Products will be offered at LTCART's sole discretion, subject to separate terms, eligibility requirements, and pricing disclosed at the time of offer. Protection Products are distinct from LTCART's standard platform services and do not modify, expand, or supersede any limitation of liability set forth in these Terms. LTCART makes no current guarantee of transaction outcomes and reserves the right to introduce, modify, or discontinue any Protection Product at any time without notice.
